Článek pojednává o procesních otázkách souvisejících s řízením o odstranění pevné překážky umístěné svévolně na veřejné cestě. Zabývá se zahájením řízení, okruhem účastníků tohoto řízení, jeho vztahem k řízení o existenci pozemní komunikace, možností vydat předběžné opatření, rozhodnutím ve věci a dalšími způsoby ukončení řízení, výkonem rozhodnutí a konečně i procesním řešením situace, kdy vlastník překážky je neznámý.

The Article deals with procedural questions connected with proceedings
to remove a barrier arbitrarily placed on a public way. It deals with commencement of the proceedings, parties to the proceedings, relation to proceedings concerning declaration of road existence, possibility to issue a preliminary measure, decision on merits and other forms of closing of proceedings, execution of a decision and, finally, also procedural solution of the situation when owner of the barrier is unknown.
