The aim of this article is to describe historical development of political asylum on the territory of the present Czech Republic, after Czechoslovakia came into existence, and its influence on constitutional regulation of asylum in Art. 43 of the Charter of Fundamental Rights and Freedoms. The author describes granting of asylum to the foreigners who were persecuted during the First Czechoslovak Republic´s era. Subsequently, the article focuses on regulation of this topic after the Second World War in Czechoslovakia and other countries in Eastern Europe. Finally, the author describes changes arriving during the process of transformation of constitutional systems in the 90s in these countries and specifically in Czechoslovakia and the Czech Republic. The author expresses his own opinion concerning basic consequences arising for the interpretation of Art. 43 of the Charter of Fundamental Rights and Freedoms from the above mentioned historical grounds.
