Článek se zabývá problematikou poskytování informací ze spisů podle zákona č. 106/1999 Sb., o svobodném přístupu k informacím, a podle zákona č. 500/2004 Sb., správní řád. Příspěvek poukazuje na rozdílnost povahy práva na poskytnutí informace podle obou zmíněných předpisů. Tato rozdílnost je při posuzování možnosti poskytnutí informace v konkrétním případě určující.

Summary:
The article analyses the issue of disclosure of information contained in administrative files under Act No. 106/1999 Coll., on Free Access to Information, and under Act No. 500/2004 Coll., Code of Administrative Procedure. It points out the difference in the characteristics of the rights to receive information under both of the acts. The difference is decisive for the assessment of the possibility to disclose the information in a particular case.
