Tento článek je zaměřen na problematiku právní regulace zábavní pyrotechniky v městech a vesnicích obecně závaznými vyhláškami obcí. Součástí toho je zkoumání judikatury Ústavního soudu, jak pohlíží na vydávání takovýchto vyhlášek. Článek poukazuje na častý střet používání zábavné pyrotechniky s ochranou zvířat. Uvádí se zde ty nejdůležitější právní předpisy na ochranu zvířat a na ochranu přírody, jež by měly být při takových akcích dodržovány a na které by měla brát zřetel i legislativa obcí. Závěrem je konstatování, že je důležité, aby obce tyto aktivity regulovaly.
Entertainment pyrotechnics from the animal protection perspective – summary:
The article is focused on legal regulation of entertainment pyrotechnics in communities by means of ordinances of communities. It deals with research of case-law of the Constitutional Court, especially its point of view concerning issuing of such ordinances. The article points to the frequent conflict of entertainment pyrotechnics use with animal protection. The most important legislation relating to animal protection and nature protection is mentioned. This legislation has to be observed during such activities and must be taken into account by communities when drafting their ordinances. The author concludes it is important to regulate these activities on community level.
