SOUHRN
Článek se zabývá nařízením vlády č. 455/2009 Sb., kterým se pro účely trestního zákoníku stanovuje, které rostliny nebo houby se považují za rostliny a houby obsahující omamnou nebo psychotropní látku a jaké je jejich množství větší než malé a nařízením vlády č. 467/2009 Sb., kterým se pro účely trestního zákoníku stanoví, co se považuje za jedy a jaké je množství větší než malé u omamných látek, psychotropních látek, přípravků je obsahujících a jedů. Je rozebrána vhodnost této právní úpravy, její soulad s právním řádem, vázanost soudu nařízeními při posuzování pachatelů a možný právní omyl pachatele.

The larger than small amount of a drug according to the new penal code
SUMMARY
The article discusses government decree No. 455/2009 Sb., which, for the purposes of the penal code, determines which plants and mushrooms are considered to be plants and mushrooms containing narcotic or psychotropic substances and what amount is larger than small, and government decree No. 467/2009 Sb., which, for the purposes of the penal code, determines, what is considered to be a poison and what amount is larger than small in the case of narcotic and psychotropic substances and preparations containing poison. The suitability of this enactment is discussed and its correspondence to the body of laws, liability of court to these decrees when assessing offenders and the possible ignorance of law on the part of the offender.

Größer als geringe Menge Drogen nach dem neuen Strafgesetz
ZUSAMMENFASSUNG
Der Artikel befasst sich mit der Regierungsverordnung Nr. 455/2009 Slg., die für die Zwecke des Strafgesetzbuches festlegt, welche Pflanzen beziehungsweise Pilze für Pflanzen oder Pilze gehalten werden, die einen Rausch- beziehungsweise psychotropen Stoff enthalten und welche Menge für größer als gering gehalten wird sowie mit der Regierungsverordnung Nr. 467/2009 Slg., die für die Zwecke des Strafgesetzes festlegt, was als Gifte betrachtet wird und welche Menge bei Rauschgiften, psychotropen Stoffen, den sie enthaltenden Präparaten und Giften für größer als gering gehalten wird. Weiterhin wird im Artikel die Nutzbarkeit dieser rechtlichen Regelung, ihre Übereinstimmung mit der Rechtsordnung, die Bindung von Gerichten an Verordnungen beim Beurteilen der Täter und der mögliche rechtliche Irrtum des Täters erläutert.
